Kan en samtykkelov utgjøre et tilstrekkelig vern mot voldtekt? / Can a consent law provide sufficient protection against rape?

NORWEGIAN:

Internasjonalt Seminar er et informasjons- og debattforum i Tromsø, som gjennom foredrag og paneldiskusjoner tar opp nord/sør-problematikk, miljø/klima, fattigdom/utvikling og krig/fred som sentrale tema.

Torsdag 7. mars kl. 19.00-21.00, på Tromsø bibliotek holdes det et nytt møte i Internasjonalt Seminar.

Tema for neste møte er voldtekt.

Én av fem kvinner i Norge har vært utsatt for voldtekt, viser en ny, landsomfattende undersøkelse. Kvinnene hadde opplevd voldtekt ved bruk av makt eller tvang, eller mens de sov.

41 prosent hadde ifølge samme undersøkelse vært redde for å bli alvorlig skadet eller drept under overgrepet. Tallene er skremmende, og må tas på alvor i arbeidet mot voldtekt og seksuelle overgrep.

Regjeringen fastslo i sin politiske Hurdalsplattform at vi skal få en samtykkelov i Norge. Til nå har 12 europeiske land innført samtykkelov. Straffelovrådet la i desember 2022 frem sitt forslag, der de forutsetter at den som blir utsatt for et overgrep må uttrykke sin motvilje i ord eller handling før det kan defineres som en voldtekt.

Spørsmål som skal tas opp på neste debattmøte:

• Er en slik samtykkelov et godt nok vern mot voldtekt eller er det en falsk medisin? 
• Hva holder som bevis i en straffesak?
• Hvordan kan vi sikre oss en samtykkelov som er noe mer enn retten til å si nei til sex?

The International Seminar is a forum for political debate in Tromsø, that addresses issues of the North/South divide, environment/climate, poverty/development, and war/peace as central themes through lectures and panel discussions.

On Thursday, 7 March, from 7:00 PM to 9:00 PM, at the Tromsø Library, a new meeting of the International Seminar will be held.

The topic for the next meeting is rape.

One in five women in Norway has been subjected to rape, according to a new, nationwide survey.

The women had experienced rape involving the use of force or coercion, or while they were asleep. According to the same survey, 41 percent had been afraid of being seriously injured or killed during the assault.

These figures are alarming and must be taken seriously in the fight against rape and sexual assault. The government confirmed in its political Hurdal Platform that we will have a consent law in Norway.

To date, 12 European countries have introduced a consent law. In December 2022, the Criminal Law Council presented its proposal, which assumes that the person subjected to an assault must express their objection in words or actions before it can be defined as rape.

Questions to be addressed at the next debate meeting:

• Is such a consent law sufficient protection against rape, or is it a false remedy?
• What counts as evidence in a criminal case?
• How can we ensure a consent law that is more than just the right to say no to sex?
